1. About these terms
These Terms of Use ("Terms") govern your access to and use of the OurTrial platform ("Platform"), operated by OurTrial ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
These Terms should be read alongside our Privacy Policy, which forms part of this agreement.
2. What PsychTrial is
OurTrial is a digital coordination platform that connects clinical trial coordinators, doctors and other clinicians, and research participants across Australia. The Platform enables:
- Trial coordinators to publish and manage clinical trials
- Psychiatrists to discover trials, refer patients, and track their journey
- Participants to browse trials, submit expressions of interest, and manage their participation
2.1 What OurTrial is not
OurTrial is a coordination and communication platform. It is not:
- A medical device or clinical decision-support tool
- A source of medical advice, diagnosis, or treatment
- A clinical trial registry (such as the Australian New Zealand Clinical Trials Registry)
- A substitute for the judgment of a qualified medical professional
- An agent, sponsor, or investigator for any clinical trial listed on the Platform
All clinical decisions remain the responsibility of qualified medical professionals. Participation in any trial listed on PsychTrial is subject to the trial's own consent and eligibility processes, which are managed by the trial coordinator independently of PsychTrial.
3. Eligibility and account registration
3.1 Age requirement
You must be at least 18 years of age to create an account on PsychTrial. By registering, you confirm that you meet this requirement.
3.2 Account types
The Platform supports three user roles:
- Participants — any individual aged 18 or over who wishes to explore or apply for clinical trials. Participants receive immediate access upon email verification.
- Psychiatrists / Doctors — registered medical practitioners with a valid AHPRA registration. Doctor accounts are subject to AHPRA number verification before full access is granted. Doctors may browse trials immediately after signup but cannot invite patients or access patient management tools until verified.
- Trial Coordinators — research staff employed by or affiliated with a hospital, university, or research organisation conducting clinical trials. Coordinator accounts are subject to organisation verification before trial management access is granted.
3.3 Account accuracy
You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date. Providing false or misleading information — including a false AHPRA number — is a material breach of these Terms and may result in immediate account suspension and referral to the relevant regulatory authority.
3.4 Account security
You are responsible for maintaining the confidentiality of your account credentials. You must not share your login details with any other person. You agree to notify us immediately at hello@ourtrial.com.au if you suspect unauthorised access to your account.
4. Acceptable use
You agree to use the Platform only for its intended purpose and in accordance with these Terms and all applicable laws.
4.1 You must not:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
- Impersonate any person or entity, or misrepresent your professional credentials or affiliation
- Upload, transmit, or share content that is false, misleading, defamatory, offensive, or harmful
- Attempt to gain unauthorised access to any part of the Platform or any other user's account
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Platform without our written permission
- Harass, threaten, or intimidate other users
- Use the Platform to spam or send unsolicited communications to other users
- Attempt to circumvent any security measure or access control on the Platform
- Reproduce, redistribute, or commercially exploit any content from the Platform without our express written permission
4.2 Coordinator obligations
Trial coordinators who publish trials on the Platform represent and warrant that:
- The trial has received all required ethics committee approvals
- All trial information published on the Platform is accurate and not misleading
- They have authority to represent the trial and the sponsoring organisation
- They will handle participant information in accordance with the Privacy Act 1988 and all applicable research ethics obligations
- They will manage participant consent and eligibility through appropriate clinical processes independent of PsychTrial
4.3 Doctor obligations
Doctors using the Platform to refer patients represent and warrant that:
- They hold a current, valid AHPRA registration
- They have obtained appropriate consent from any patient they refer or invite to a trial
- They are acting within their scope of practice
5. Content and intellectual property
5.1 Your content
You retain ownership of any content you upload or submit to the Platform ("User Content"), including trial documents, messages, and profile information. By submitting User Content, you grant OurTrial a non-exclusive, royalty-free licence to store, display, and transmit that content as necessary to operate the Platform.
You are solely responsible for any User Content you submit. You warrant that your User Content does not infringe any third party's rights and complies with these Terms.
5.2 Platform content
All Platform features, design, software, and content created by PsychTrial are our intellectual property and are protected by Australian and international intellectual property laws. You may not reproduce, modify, or distribute our content without our express written permission.
5.3 Trial information
Trial information published by coordinators is the responsibility of the publishing coordinator and their organisation. PsychTrial does not verify, endorse, or take responsibility for the accuracy or completeness of trial listings.
6. Privacy
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
When a participant submits an expression of interest for a trial, they consent to their contact information being shared with the relevant trial coordinator. This consent is obtained explicitly at the point of submission.
7. Disclaimers and limitation of liability
7.1 No medical advice
Nothing on OurTrial constitutes medical advice. The Platform is a coordination tool only. All decisions about participation in clinical trials should be made in consultation with a qualified medical professional.
7.2 No warranty on trial information
We do not verify the clinical, regulatory, or scientific accuracy of trial information published by coordinators. We make no representations about the suitability of any trial for any individual participant.
7.3 Platform availability
We aim to maintain the Platform's availability but do not guarantee uninterrupted access. We may suspend access for maintenance, security, or other operational reasons without notice.
7.4 Limitation of liability
To the maximum extent permitted by Australian law, OurTrial and its operators will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Platform, including loss of data, loss of revenue, or harm resulting from participation in a clinical trial facilitated through the Platform.
Our liability for any claim arising from your use of the Platform is limited to the amount you have paid us in the 12 months preceding the claim (which, given the Platform is currently free to use, may be nil).
Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
8. Suspension and termination
We may suspend or terminate your account at any time if:
- You breach these Terms
- We reasonably believe your account poses a risk to other users or to the Platform
- Your AHPRA registration (for doctors) is suspended or cancelled
- You provide false information during signup or verification
- We are required to do so by law
You may close your account at any time by visiting your profile, navigating to Account Settings, and selecting Delete my account. Alternatively, contact us at hello@ourtrial.com.au. Closure of your account does not affect any obligations that arose before closure.
9. Changes to the Platform and these Terms
We may modify the Platform or these Terms at any time. We will notify registered users of material changes by email and update the "Last updated" date at the top of this document. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Victoria.
